Wentland v 2192724 Alberta Inc. o/a Pac Masonry, 2023 AHRC 95 (CanLII)
Mathew Wentland, alleges that the respondent, 2192724 Alberta Inc. o/a Pac Masonry, discriminated against him in the area of employment on the grounds of age and sexual orientation
The complainant stated further that his supervisor knew that the complainant’s sister is transgender; hence the supervisor made degrading statements about his sister’s sexual orientation. The complainant testified that he sometimes got mad with his supervisor for making these comments, but sometimes he simply brushed off the comments.

The complainant testified that he disclosed his sexual orientation to his supervisor so that he would not insult him and his sister. He stated that after the disclosure, the supervisor’s inappropriate behaviour toward him got worse. He stated that the supervisor’s inappropriate behaviour included making derogatory comments about his sexual orientation, throwing rocks and cement at him, putting burning cigarettes in his pants, not allowing him to eat, and putting a spider underneath his shirt.

While the makers of these comments may not have intended to discriminate or offend, intention is irrelevant in determining discrimination under the Act.

Intention or motive is irrelevant to the question of adverse impact. The fact that the maker of a derogatory statement did not subjectively intend to hurt or injure the addressee does not mean that the statement cannot constitute or cause an adverse impact.

The respondent is hereby ordered to pay to the complainant the amount of $15,000.00 as general damages for injury to dignity
Local perennial candidate Karin Litzcke tried to gain intervenor status in the Saskatchewan "forced outing" case.
"On September 15, 2023, materials were faxed to the office of the local registrar by an entity named Our Duty Canada Group. The materials indicated this group sought intervenor status in the proceedings, but the documents were completely unreadable and appeared to have been submitted by an individual, non-lawyer, named Karin Litzcke. The Local Registrar requested this individual re-fax the material in a readable form. That was done on Sunday, September 17, 2023 and was retrieved by the deputy Local Registrar and forwarded to me at approximately 8:00 p.m. that evening. The materials have not been served on the parties to this action."
A potential intervenor needs to send copies of their application to those involved in the legal case to allow them to challenge intervenors applying for an improper purpose.
They can't just fax documents to the court clerk on a Sunday evening when the hearing is on a Tuesday.
Karin Litzcke is not blocked from proceeding further "I will address any such application, if and when, it is substantively before the court."

A National Post Hit Piece dishonestly lumps breast reductions for cis people together with gender affirming top surgeries.
"Of the 4,071 visits in total involving gender-affirming mastectomies or breast reductions reported since 2018, 602 involved youth 18 and under.
Of those, 303 involved teens 17 and younger. The youngest age was 14."
No comment yet on whether the "youngest age" case was a gender affirming top surgery or a breast reduction for a cis teen.
